Terms of Service

1. Agreement to Terms
By purchasing, accessing, or using The Offer Engine program ("Program"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Program.
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Creating Your Plan ("Company," "we," "us," or "our"), operator of The Offer Engine program.
2. Program Description
The Offer Engine is a business consulting program designed specifically for established professional service providers, consultants, and experts. The Program consists of:
- Three-Phase System: Lock the Offer, Test the Message, Sell the Work
- Self-paced digital content with immediate access upon payment
- Tools, templates, and frameworks for business development
- 90-day support period including asynchronous review and weekly office hours
- Educational materials focused on revenue growth and client positioning
3. Eligibility and Target Audience
The Offer Engine is designed for established business owners and experts with existing consulting or professional service practices. This Program is NOT intended for beginners or those without established expertise in their field.
By enrolling, you represent that you:
- Are at least 18 years of age
- Have legal authority to enter into this agreement
- Are an established professional service provider, consultant, or expert
- Have the necessary business experience to implement advanced strategies
4. Payment Terms
4.1 Pricing Options
Two payment options are available:
- One-time payment: $1,000 USD
- Payment plan: Three monthly payments of $500 USD each ($1,500 total)
4.2 Payment Processing
All payments must be completed before accessing Program materials. Payment plan customers receive immediate access upon first payment but must maintain current payment status. All payments are non-refundable (see Section 6: No Refund Policy).
4.3 Late Payments
If you select the payment plan and fail to make scheduled payments when due:
- Access to the Program will be immediately revoked
- Support services will be terminated
- No refunds will be provided for any payments made
- You remain liable for all outstanding amounts
5. Access and Support
5.1 Program Access
Upon successful payment, you will receive immediate access to all Program materials through our designated platform via https://theofferengine.co/.
5.2 Support Period
Support is provided for 90 days from your enrollment date and includes:
- Asynchronous review of your work and questions
- Weekly office hours for live interaction
- Access to community resources during support period
5.3 Technical Requirements
You are responsible for maintaining compatible technology and internet access to utilize the Program.
6. No Refund Policy
ALL SALES ARE FINAL. No refunds, returns, or exchanges will be provided under any circumstances, including but not limited to: change of mind or business priorities, inability to implement strategies, lack of expected results, technical difficulties on your end, or failure to participate in support activities.
7. Intellectual Property Rights
7.1 Company Ownership
All Program content, including but not limited to text, graphics, videos, audio, software, templates, frameworks, and methodologies, are the exclusive property of Creating Your Plan and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License (Internal Use Only)
You are granted a limited, non-exclusive, non-transferable license to access and use Program materials solely for internal use within your own business. This license is limited to the original purchaser and their immediate internal team (employees or contracted team members working within your business). Materials may be used only for your business's internal strategy and operations and may not be used in any client-facing work, deliverables, or training.
7.3 Restrictions
You may NOT:
- Reproduce, distribute, or share Program materials with clients, peers, the public, or any third party outside your business
- Create derivative works based on Program content for client-facing or commercial use
- Use materials to train, certify, or educate clients or third parties
- Reverse engineer or attempt to extract methodologies for redistribution
- Transfer your access to another person or entity
For licensing or permission to use Program content with clients, in trainings, or across multiple businesses or teams, email success@creatingyourplan.com to request written authorization.
7.4 Enforcement; Immediate Termination on Breach
Any actual or suspected breach of this Section 7 will result in immediate termination of access to the Program without refund, and we reserve all rights to pursue legal and equitable remedies.
8. Results Disclaimer
8.1 No Guaranteed Outcomes
We provide educational content and business strategies, but we cannot and do not guarantee any specific business results, revenue increases, or client acquisition outcomes.
8.2 Testimonials and Case Studies
Any testimonials, case studies, or success stories presented are real examples from actual clients. However, these results are not typical, and individual outcomes will vary based on:
- Your existing business foundation
- Market conditions
- Implementation consistency
- Industry-specific factors
- Economic circumstances
8.3 Your Responsibility
Success with the Program requires your active participation, consistent implementation, and adaptation of strategies to your specific business context.
9. User Responsibilities
9.1 Professional Conduct
You agree to maintain professional conduct in all interactions with Company representatives and other Program participants.
9.2 Accurate Information
You must provide accurate contact and payment information and promptly notify us of any changes.
9.3 Compliance with Laws
You are responsible for ensuring your use of Program strategies complies with all applicable laws and regulations in your jurisdiction.
10. Privacy and Data Protection
Your personal information will be handled according to our Privacy Policy, which is incorporated by reference into these Terms.
11. Limitation of Liability
To the maximum extent permitted by law:
11.1 Disclaimer of Warranties
The Program is provided "AS IS" without warranties of any kind, express or implied.
11.2 Limitation of Damages
Creating Your Plan's total liability to you for any claims arising from or related to the Program shall not exceed the amount you paid for the Program.
11.3 Excluded Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue.
12. Termination
12.1 Termination by Company
We reserve the right to terminate your access to the Program immediately if you:
- Violate these Terms
- Engage in fraudulent payment practices
- Share or distribute Program materials unauthorized
- Fail to make required payments under payment plans
12.2 Effect of Termination
Upon termination, all rights and access cease immediately, and no refunds will be provided.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where Creating Your Plan is established, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the Program shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on https://theofferengine.co/ with a new effective date. Continued use of the Program after changes constitutes acceptance of modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Creating Your Plan regarding purchases of The Offer Engine program.
